Introducing Agreement of Terms & Conditions and Notes

Hours of Operation

We are able to lend out our equipment starting from 15:00 on the business day prior to the day of intended use, and we ask that the customer return their rental by 12:00 on the business day following the last day in which it was used.

Discounts for Number of Days

We will apply a discount to those who have rented our product over an extended number of days (5 days or over). However, this discount will only be applied based on the number of days marked at the time of reservation.
In the event that the rental period is extended or the rental is returned late, please note that we will charge the customer the original price applicable for the number of days rented.

Points of Caution

• ・When renting equipment, we ask that the customer present us with a valid form of picture identification (a driver’s license or passport) together with the customer’s business card.
• ・First-time customers will be required to pay for rental expenses in full and in cash when renting their equipment.
• ・A cancellation fee will be charged to the customer if they cancel their reservation either on the day of or the day before they intend to rent our equipment.
• ・Please perform an adequate inspection of rented equipment to ensure that there is no damage or any malfunctions present prior to use.
• ・If the rental equipment has been damaged, lost, or stolen, please immediately reach out to our supervisor.In this case, damage refers not only to exterior damage, but also to damage/failure/outage of electronic apparatuses, equipment, or parts.
• ・Our firm has insured the rental equipment with domestic insurance coverage (with a deductible of 100,000 yen).
• ・We ask that the customer makes their own arrangements to enroll in the proper insurance in the case that they intend to use the rental equipment overseas. Please consult with us if you are unable to enroll in such insurance.
• ・When the rental equipment is damaged and the cause of such damage can be attributed to any of the following causes, such charges will not be covered by our firm’s insurance: disaster, willful negligence/intentional damage by the customer, aerial shooting, any damage during use overseas, loss, theft, etc.
• ・In the event that any malfunction of the item occurs during use, our firm will not be held responsible for any damages relating to work being created with our equipment. However, we will make every possible effort to supply replacement equipment.
• ・Late fees will be charged to the customer if they are unable to return the equipment rented by the planned day of return.
• ・In the event that we are not able to confirm the customer’s deposit on the payment deadline date specified at the time of contract signing, we will not accept any further order placements until said payment has been successfully confirmed.
• ・Rental prices may be subject to change without prior notice.

Terms of Agreement

This agreement is made between and entered into by the Borrower (hereinafter referred to as the 'Borrower') with KOKIHIFUMI INC. (hereinafter referred to as the 'Renter') as follows concerning the rental of business-use photography equipment (hereinafter referred to as ‘Equipment’).

• 1. The Borrower shall take adequate care in the storage and use of rented Equipment.
• 2. The Borrower (or the supervisor in charge if the Borrower is a corporation) shall present a form of picture identification (driver’s license, passport, or My Number Card) along with a business card to the Renter.
• 3. The Borrower shall, after confirming the Equipment ordered, the number of units, the specified date, sign the specified receipt provided by the Renter when renting Equipment.
• 4. The Borrower shall, prior to using rented Equipment, perform a sufficient inspection to make sure there are no inconveniences present. The Borrower shall not charge the Renter for any compensation for damages, even in the event that the rented Equipment breaks down or malfunctions during use.
• 5. In the event that the Borrower cancels their reservation on the day of or on the day before the start of their rental reservation, the Borrower shall pay cancellation fees to the Renter.
  In the event of an accident, the Lessee shall bear the costs of any equipment repair fees or interference of business compensation fees.
• 6. The Borrower shall strictly abide by the set period of use.
  In the event that the Equipment rented cannot be properly returned by the specified return date, the Borrower shall immediately contact the Renter to confirm any resultant late fees as well as the date they will be able to return said Equipment.
• 7. In the event that the Equipment has been damaged, lost, or stolen, etc. (referred to as “Damages” below) due to an accident, the Borrower shall swiftly inform the Renter of such occurrence. Said Damages refer not only to exterior damage, but also include damage/failure/outage of electronic apparatuses, equipment, or parts.
• 8. In regards to the responsibility of compensation of damage attributed to Damages listed above, the following rules shall be followed in the handling of such compensation.
  
  • ・Per one piece of Equipment, in the event that the costs for Damages are less than 100,000 yen (tax included), the Borrower shall be responsible for the payment of those costs in full.
  • ・Per one piece of Equipment, in the event that the costs for Damages exceed 100,000 yen (tax included), it will be the responsibility of the Borrower to pay for charges up to 100,000 yen. Any charges that exceed 100,000 yen shall be covered by the Renter, who will be covered by Japanese domestic property insurance.
  • ・However, in the event that the Borrower intends on utilizing insurance enrolled in for the purpose of handling costs for said Damages, the Borrower shall contact the Renter and inform them of this. In this case, the Renter shall provide all documents required for the use of said insurance to the Borrower.
  • ・The Renter, after consulting with the Borrower, may charge the Borrower for compensation for business interruption (the equivalent rental cost for the period required for the full repair of the Equipment in question).
  • ・The Borrower shall be responsible for paying all costs not be covered by the Renter’s property insurance.
• 9. The following damages and costs will not be covered by the property insurance enrolled in by the Renter.
  
  • ・Damages due to disaster, etc.
  • ・Damages due to the intentional misuse of the Borrower.
  • ・Damages incurred by way of aerial photography (including use by multi-copter or drone).
• 10. Because the Renter’s property insurance does not cover any damages made to Equipment while overseas, the Borrower shall enroll directly in insurance in the event that they utilize the Equipment overseas.
• 11. The Borrower shall not transfer, sublet, establishment the right of pledge, or perform any other acts infringing on the rights and privileges of the Renter.
• 12. Upon the first-time transaction with the Renter, the Borrower shall pay due fees in cash in entirety at the time the Borrower is loaned such Equipment.
• 13. The Borrower shall, if any of the following circumstances apply to them, return the rented equipment immediately to the Renter. In addition, if the Renter orders a suspension of dealings to the Borrower, the Borrower shall follow said order.
  • A) The Borrower violates any of the terms of this Contract.
  • B) The Borrower becomes subject to compulsory execution, provisional seizure, or provisional injunction.
  • C) It can be concluded that there has been a remarkable decrease in the Borrower’s credit status.
  • D) Payment of the rental fees becomes overdue.
• 14. The Borrower acknowledges and is in agreement that the rental price of Equipment is subject to change without notice.
• 15. In the event that the Renter is not able to confirm the Borrower’s deposit on the payment deadline date, the Borrower will not be able to place further orders until said payment has been successfully confirmed.
